These Terms of Service ("Terms") govern your use of the websites, mobile games and related services (the "Services") operated by OffRoad Group LLC ("Offroad Interactive", "we"). By using the Services you agree to these Terms.

1. Eligibility

You must be the older of 13 years, the minimum age of digital consent in your country, or the age stated on the game's storefront rating, to use the Services. If you are under that age, use the Services only with consent and supervision of a parent or guardian.

2. Your account and content

You are responsible for activity on your account and the content you create in our games. You grant us a worldwide, royalty-free licence to host, store, reproduce and display user-provided content solely to operate and improve the Services.

3. Acceptable use

No reverse engineering, cheating, bots, scraping, or circumventing technical measures.
No unlawful, harassing, infringing or harmful use.
No attempts to disrupt servers, matchmaking or other players' enjoyment.

4. Purchases and virtual items

All payments are processed by Apple App Store or Google Play. Virtual items, currencies and content are licensed — not sold — and have no monetary value, cannot be transferred outside the game, and are non-refundable except as required by law or the storefront's policies. See our Refund Policy.

5. Updates and availability

We may modify, suspend or discontinue any Service, feature, or game at any time. We'll use reasonable efforts to notify material changes.

6. Intellectual property

The Services, game art, code, audio, trademarks and logos (including "Offroad Interactive", "Offroad Arcade", "Superhero Maker", "Dubai Offroad") are owned by OffRoad Group LLC or its licensors. We grant you a personal, non-transferable licence to use the Services for personal entertainment — see the EULA.

7. Third-party services

The Services may link to or integrate third-party services. We are not responsible for them; your use is governed by their terms.

8. Termination

We may suspend or terminate access for breach. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFROAD GROUP LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE OR DATA. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) US$50 OR (B) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnity

You agree to indemnify and hold us harmless from any claims arising out of your breach of these Terms or misuse of the Services.

12. Governing law and dispute resolution

These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. Any dispute will be resolved by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association. You and we waive the right to bring disputes as class actions. This section does not apply where prohibited by local law.

13. Changes

We may update these Terms by posting a new version here. Continued use after changes means you accept them.
